Family And Children Law

We can assist you with a variety of family and children law matters, including divorce, the primary care of children, contact rights, the rights of children and maintenance.

Although Family and Children law may appear at first to be simple in the eyes of some lacking the full knowledge of the depth of this field, this field of practice is volatile and changes almost on a day-to-day basis due to the evolving of the principles governing Family and Children Law by the Courts. This area of practice therefore calls for skilled knowledge and expertise.

Family and Children Law matters are regulated mainly within the ambit of the Divorce Act, the Matrimonial Property Act as well as the Children’s Act.

Labour Law

We have extensive experience in representing both employers and employees in Labour law cases. The Labour law environment is involved with disputes between employers and employees.

This further involves disputes such as unfair labour practices, discrimination in the workplace, incapacity, dismissal on operations requirements (so-called “retrenchments”), unfair dismissals, voluntary separation agreements, the obtaining of declaratory orders and the general protection of employees within the regulatory framework of the Labour Relations Act and Basic Conditions of Employment Act.

Commercial/Corporate Law

Our attorneys are well-versed in the complexities of Commercial and Corporate law. Commercial and Corporate law involves all aspects of Enterprise law, involving the “birth” of an enterprise starting up as a one-man enterprise, evolving into small/medium enterprises and evolving, sometimes, into huge corporate entities.

The interaction between partners and/or directors, internally, should be well regulated in law, but so also the external relationships any enterprise develops with third parties/clients.

We assist with all aspects of Commercial and Corporate law.

Banking Law

Banking law is a sub-component of Commercial law. Presently the bank/client relationship is regulated by the National Credit Act.

Persons who intend setting up a business will, out of necessity, require banking services to be rendered to a successful enterprise.

Personal Injury Law

Personal Injury law is based on the recklessness or negligence of another party, causing personal (bodily) harm to the injured.

Personal Injury law is a complex and involved process and should, similarly, not be approached without expert knowledge in this field of the law. We assist with all cases of personal injury law, excluding motor vehicle accident claims.

The Law of Trusts

The law of Trust is a complicated legal field which should not be experimented with, without proper knowledge and a proper trust deed to be registered. Poorly drawn trust deeds have led to the collapsing of many good intentions founders of trusts had when establishing a trust for the benefit of others.

A trust deed can be seen as the “constitution” of any trust and should be carefully drafted by a skilled person. We assist with all aspects of the Trust law and are satisfied that our experience in this field of the law can prevent results not foreseen by a founder(s) of a trust.
